1.1 Approval of Reading by Title only and Waiver of Reading in full of Ordinances on
Agenda.
1.2 Ratification/Approval of Warrant Registers for the periods of January 20 through
January 24, 2014 and January 27 through January 31, 2014.
1.3 Acceptance of the General Construction Project, Bid No. 13-021, from Nuera
Contracting & Consulting LP, as complete; Authorize the City Clerk to file and
record the Notice of Completion; Authorize the release of the retention in the
amount of $12,392.20, if unencumbered, 45 days after City Council acceptance;
Release the Bond for Material and Labor in the amount of $280,086.95 and retain
the Bond for Faithful Performance for a period of one year.
1.4 Acceptance of the 2013-2014 Street Maintenance Project, Bid No. 13-016, from
VSS International, Inc., as complete; Authorize the City Clerk to file and record the
Notice of Completion; Authorize the release of the retention in the amount of
$56,456.83, if unencumbered, 45 days after City Council acceptance; Release the
Bond for Material and Labor in the amount of $1,043,651.00 and retain the Bond
for Faithful Performance for a period of one year.
1.5 Award of Contract to Willdan Financial Services, Inc., for Annual Levy Process for
Special Districts and Fire Protection Special Tax, RFP 14-007.
1.6 Approval of Agreement between the City of Poway and SeatAdvisor, Inc., for
ticketing software at the Poway Center for the Performing Arts.
1.7 Report of Emergency Clean-up Expenditures Pertaining to Hydraulic Fluid Spill into

Number of potential cases: 1
Facts and Circumstances Known to Potential Plaintiffs: In the construction of the Viewpoint Estates Project certain public improvements, required to be constructed by the developer, were either incomplete or not constructed in compliance with the plans and specifications of the City. The developer's surety under the improvement bonds was notified of these insufficiencies, and (before the City took action to seek judicial enforcement of the bonds) has been working toward the completion of the required public improvements. Certain issues remain with respect to how the required improvements should or will be completed, in order to comply with City requirements.
